yoerks nbc news. we have information on the second homicide of the year in san jose. police identified the woman shot to death yesterday as anna deyoung, a 43-year-old mother of two, found shot but alive inside her apartment near 101 and tully road but died later at the hospital. it neighbors say she was running a small business out of her apartment. police say family members are now caring for 129-year-old son and 8-year-old daughter. so far, no motive nor any arrests. in san jose, police arrested one suspect in connection with the home invasion robbery, still looking for two others. the three men reportedly forced their by this a home in almaden valley monday night and tied up a couple in their 70s and ransacked a home. they stole both cars. police found the cars yesterday but now searching for at least two additional suspects. now to the topic of gun control, democratic lawmakers say their proposed ban on assault weapons will not impact hunters or sportsmen. california u.s. senator dianne feinstein led the news conference in washington, d.c.

win confirmation and become the 68th secretary of state. brian williams will have more at 5:30. on the road to recovery, the on the mix message deliver today by governor jerry brown at the annual state of the state address. he drew rave reviews from democrats who now enjoy a super majority but also from republicans who are plotting the fiscally conservative elements of his plan. nbc bay area's jodi hernandez is live at the state capital in sacramento with more tonight. jodi? >> reporter: not much in the way of criticism here at the state capital. after years of budget deficits, the governor says the state is finally back on track and he says he intends to keep it that way. >> we have brought in just two years a solid and enduring budget and by god, we are going to preserve and keep it that way for years to come. >> reporter: an optimistic governor brown says california has don't impossible but must do work to make sure the state

stays on solid financial ground n his 11th state of the state address the governor stressed the importance of paying down debt, building reserves and not spending money we don't have. >> it's cruel to lead people on by expanding good programs only to cut them -- cut them back when the funding disappears. this isn't progress. it's not even progressive. it's an illusion. the stop and go t, the boom and bustselves no one. we are not going back there. >> reporter: governor laid out ideas for the second half of his term, including upgrading the state's water system, investing in high-speed rail and enhancing trade with china, announcing he will lead a delegation to the country this spring. >> this year, we will take another step to strengthen the ties between the world's second and ninth largest economies. >> reporter: the governor also keyed in on education, pledging to bring more money for schools in low-income neighborhoods and vowing to do all he can to keep college costs down. >> the key here is thoughtful

change, working with the faculty and the college presidents. but tuition increases are not the answer. i'm not gonna let the students of california become the default financiers of our colleges and universities. >> he's a champion for education, for dealing with the inequalities in our state. he has a heart and a mind that are really focused on improving the state. >> reporter: governor's address is getting high marks from lawmakers. even republicans could find little to criticize. >> i think the governor is a fiscal conservative as well. i think his last -- his first two years and even his previous stint as governor have shown that he is very tight with the pocketbook and i think his speech identified that as well. so, i don't think we are going to have -- personally, i don't think i will have any issues with the governor when it comes to spending. >> reporter: now, normally, we would see scathing criticism from the owe popposing party. that was not the case today. the senate republican leader is encouraged by the governor's

crews are digging up part of

a street in green bray to try to fix a water main that ruptured under the roadway this morning. it happened near sir francis drake boulevard. chp officers tell us at one point, water was shooting six feet into the air. at the rate of 1500 gallons minute for 90 minutes. the break was capped but about a dozen homes are still without water tonight. crews are now making sure the roadway is still structurally sound. investigators in the central valley have started excavating a new well linked to the speed freak killers. the as well in linden, the same area where another well was excavated which revealed the remains of some of the victims of lauren herzog and we shall wesley sherman tine. several of the victims' families criticized investigators for using heavy equipment, saying it may have damaged the remains. fbi and technical experts are taking a more careful approach on this new well, using a bore and a camera to analyze the site first. once they know what's there, they plan to excavate the well by hand, a process that will take several days, if not weeks.

in health matters, there's a link between lightning and a migraine. researchers followed a group of migraine sufferers, asking them to record their headaches for three to six months. the study found that 31-year-old increased risk of headache and a 28% increased risk of migraine on days lightning struck within 25 miles of a person's home. experts say that electromagnetic waves from lightning may to be blame. multitasking may not be as easy as you thought. the university of utah measured perceived versus actual multitasking ability of 300 college students. many who thought they were better than average and multitaxed often tended to have the lowest scores. researchers say frequent multitaskers can have difficulty focussing you and can get drawn into a second task. i know that using the phone and driving is a good example. experts believe these findings support stricter laws limiting you cell phone use while in the car. and now an update on the investigation into boeing's 787

dreamliner. federal officials said today they are still far from determining a cause. we were expecting new information about the fires and failures of lithium iron batteries aboard two green liners. no one was injured but the faa grounded all 50 planes in service. the san jose-to-japan flights have been canceled through at least january 28th. apple stock continued to slide today. it fell $63 today, more than 12%, to $450 a share. that's down $250 to september. the slump took billions out of apple's overall worth, what business analysts call the market cap. apple was so big, so huge the value of its loss is bigger than the total gross domestic product of afghanistan and bolivia combined. freedom this is freedom, to create and to do and to build and artist as individuals. >> look, you're overreacting. even if you were developing this
